Q Will my solicitor let you know I’ve remembered the Trust, and send you a copy of the Will?
A No. We will not know until the gift is actually received, unless you choose to tell us. We would love to know so we can thank you in your lifetime – and stop sending you information about gifts in Wills.
Q Can I specify where or how the money is to be spent?
A Within reason, you can, but care is needed. A general, non-specific gift is often most useful as it can be spent where most needed at the time it is received. However, if you have a strong preference it is best to ‘express the wish that’ your gift is, for example, used in your home county. But please bear in mind that if you are too specific (for example, ‘all to be spent in your local small reserve’), it may not be possible to carry out your exact wishes in the future and your gift might be forfeit. Do talk to us beforehand about your thoughts.
Q Can you advise me what I should do in my particular situation?
A We can give general advice and are very happy to talk through things with you to help you make up your mind, but we are unable to give legal advice; you should consult your solicitor about specific legal points.
